Francesca Fiorani is a Commonwealth Professor of Art History at the University of Virginia, where she served also as Associate Dean for the Arts and Humanities and Chair of the Art Department. She came to American university life after having been trained at the University of Rome "La Sapienza" in Italy, where she received her Ph.D. in Art History. She has traveled extensively and lived in many different countries, including Africa and the Middle East, and spent time as a visiting fellow in Berlin, London, Paris, Florence, among other places. Francesca writes, lectures and teaches on art. The author of The Marvel of Maps. Art, Cartography and Politics (2005), she is mainly interested in the intersections of art, science and technology in the early modern period.
A leading authority on Renaissance art and Leonardo da Vinci, she is an expert on the application of computer technology to the humanities. Her last book The Shadow Drawing: How Science Taught Leonardo da Vinci How to Paint, (New York: Farrar, Straus and Giroux, 2020; paperback 2022) was favorably reviewed in many venues, including the Wall Street Journal, the New York Times, Hollywood Soapbox, and Renaissance Quarterly, She is also the creator of the digital platform Leonardo de Vinci and his Treatise on Painting and the author of The Marvel of Maps: Art, Cartography, and Politics in Renaissance Italy (New Haven: Yale University Press, 2005; republished in 2022).
She has received awards from the John Simon Guggenheim Memorial Foundation, the American Council for the Learned Societies, the Harvard Center for Renaissance Studies at Villa I Tatti, the Getty Center, the National Endowment for the Humanities, the Folger Institute, and the Warburg Institute, among others.
She is currently working on a book about world travel around the year 1500, exploring global networks of exchange between Europe, Africa, Asia, and the Americas in the early modern period.

DAY 3 – Thursday, November 6
Cusco
Travel to the mountaintop citadel of Machu Picchu by a private, chartered train. Along the way, savor the views of the scenic Urubamba Valley. Once at Machu Picchu, which was rediscovered by Hiram Bingham in 1911, examine the artfully cut stone altars, temples, watchtower, fountains, staircases and terraced gardens that make this one of the world’s most extraordinary archaeological treasures. Enjoy afternoon tea at a local restaurant after a guided tour of the citadel. Afterwards, transfer back to the village of Aguas Calientes to catch the train for your return to Cusco. Dinner is served in the dining cars. From the station, you return to Cusco and your hotel by motor coach.

Pisco: to explore the Nazca Lines
Take an approximately 90-minute flight over the fascinating Nazca Lines [weather dependent]. Covering over 300 miles of desert hills and sands, some of the over 10,000 pre-Columbian geoglyphs stretch more than 5 miles long and 100 feet wide. Although the true purpose of the Nazca Lines are not fully known, some think they are religious offerings to the gods who would look down on them from the heavens or sacred pathways used during rituals. After lunch at the hotel, depart on an adrenaline-filled dune ride on specially outfitted 4x4 trucks driven by expert drivers. Drive up and along the sandy dunes and take in the spectacular scenery around you. Afterwards, conclude your outdoor adventure with a picnic of beverages and light snacks with the dunes as your unforgettable backdrop.

DAY 4 – Friday, November 7
Cusco
Visit the ruins of Sacsayhuaman, a monumental fortress just outside of Cusco. It is believed that the city of Cusco was laid out in the form of a puma whose head was the hill of Sacsayhuaman. Back in Cusco, admire the Convent of Santo Domingo and explore the Plaza de Armas, including the grand Cusco Cathedral with its exquisite silver altar and gold monstrance adorned with pearls and emeralds. Explore the ruins of Korikancha, or Temple of the Sun, which is the former main Inca temple of Cusco, with walls that were once covered in sheets of gold. Travel to the charming Andean village of Chinchero to explore a colorful market, visit a textile center and witness a weaving demonstration by a master Andean weaver.

Pisco
Venture by boat to the Ballestas Islands, the most important wildlife sanctuary on the Peruvian coast. This group of small, rocky islands is home to an abundance of marine birds and mammals, including blue-footed boobies, fur seals, sea lions and the vulnerable Humboldt penguins. Visit Hacienda La Caravedo, the oldest continuously operating vineyard in the Americas. Here you will enjoy a tasting of pisco, Peru's famed brandy distilled from grapes, followed by dinner and local entertainment.

DAY 5 – Saturday, November 8
Arrive in Easter Island, Chile
This morning, Cusco guests will board an hour-long flight to Pisco, where the Cusco and Pisco guests will reunite for our flight to Easter Island. Upon arrival, we will transfer directly to the hotel for check-in and dinner.

DAY 6 – Sunday, November 9
Easter Island
Today, embark on a full-day tour of the island. Encounter Ahu Tahai, the site of three restored moai, the rock statues for which the island is famous. Stop at the Rano Raraku quarry, where almost 400 giant statues remain in various stages of completion, giving insights to how these mysterious icons may have been created. Visit Ahu Tongariki, which features 15 large statues lined in a row. Enjoy a barbecue lunch on the beach then choose how you would like to explore the island further. Choose to visit the sacred site of Ahu Akivi, home to seven moai that are positioned to face sunset during the spring equinox and have their backs to the sunrise during autumn equinox. The astronomical precision of this location on the island is spectacular and unique. Opt to take a guided walk along the island’s beautiful beaches, across semi-rugged terrain to see additional moai at Ovahe and La Perouse. This evening, gather for cocktails, dinner and entertainment.

DAY 7 – Monday, November 10
Arrive in Papeete, Tahiti
Before we depart Easter Island, you may choose to rise early for a sunrise photo shoot at Ahu Tongariki. En route to the airport, you may opt for a visit to Orongo, the ceremonial center of the island’s birdman cult. Members of the cult observed an annual ritual in which they raced to bring the first egg of the manutara, or sooty tern, from a nearby island to Orongo. Here you will see petroglyphs which may have been carved to commemorate the race’s winners. Alternatively, you may choose to spend your morning at leisure and transfer directly to the airport.
Upon arrival in Tahiti, we will board a private shuttle bound for our hotel. On the way, we will pass many notable Tahitian monuments like the President's Palace, Town Hall, the Catholic Cathedral and Protestant Temple before stopping at a marketplace in the center of town. Here a guide will lead you across the market and you may enjoy time to explore the multi-storied market’s many shops and vendors. Afterwards, reboard the private shuttle and transfer to the hotel for check-in and time at leisure. This evening, enjoy a cocktail reception and private dinner with local entertainment at the hotel.

The northeast coast of Australia is home to some of the world’s most unique natural wonders. You will enjoy staying in a forested riverside hideaway in the Daintree Rainforest as well as have the opportunity to explore the UNESCO World Heritage Great Barrier Reef, the world’s largest coral reef system.

Queensland, Australia
Today, you will experience your choice of natural beauty in northeast Australia. Embark on a cruise of the Great Barrier Reef, gliding across crystal-clear waters and keeping an eye out for exotic marine life such as sea turtles, clown fish, feather stars, and reef sharks. You may even opt to explore this underwater wonderland from beneath the shimmering waves by snorkeling or scuba diving. Participate in a rainforest walk with an Aboriginal guide of the Kuku Yalanji people and experience the wonders of the Daintree Rainforest. Witness the rainforest sanctuary of rare and exotic fruit trees and wildlife facing extinction and learn more about traditional Aboriginal culture. This evening, enjoy a cocktail reception before a dine-around dinner at one of the local restaurants

Arrive in Siem Reap, Cambodia
Leaving Cairns this morning, you may choose to stop at a rainforrest habitat to learn more about Australia’s endemic flora and fauna en route to the airport. Mid-afternoon we arrive in Siem Reap, where you will check in to the hotel. Enjoy an à la carte dinner at one of the hotel restaurants this evening.

DAY 12 – Saturday, November 15
Angkor Wat
You have two unforgettable ways to visit Angkor Wat: an early morning sunrise visit or a mid-morning tour. Also known as “the city of temples,” Angkor Wat is the world’s largest religious structure built from stone. Tour the complex and meet with Buddhist monks for a blessing. Visit Ta Prohm, known for massive trees that have engulfed the temple walls over the centuries. Marvel at the Elephant Terrace and the Bayon Temple, famed for its four massive stone-carved faces of a Bodhisattva. This afternoon, transfer to Tonle Sap, Asia's largest freshwater lake and home to over one hundred floating villages. Explore the floating villages by boat to glimpse the unique daily life of the local people.
At Kulen Forest, get to handfeed elephants that have retired from the tourism industry and walk alongside them through their forest habitat. Delve deeper into local life and culture by exploring the bustling Siem Reap market, where locals sell clothing, spices, housewares, fresh food and handicrafts. This evening, dine at a local restaurant or depart on a Vespa food tour. On the Vespa food tour, you will ride through the flavorful streets of Siem Reap while escorted by a local guide. You’ll be driven around on a vintage Vespa, tasting local dishes and regional favorites from hidden gems. Depending on the schedule you choose, these activities can be chosen either today or tomorrow.

Continue your exploration of Cambodia Experience the wonders of Banteay Srei, the Citadel of Women, and explore the beautifully preserved Hindu temples made of red sandstone. Immerse yourself in the local village of Preah Dek and sharpen your culinary skills with a Royal Khmer Cooking Class. DAY 14 – Monday, November 17
Arrive in Agra
Fly into Agra in the early afternoon and discover the iconic Agra Fort. This UNESCO World Heritage site offers a stunning introduction to Agra's rich history. Later, enjoy a special cocktail party in Jodah Garden, complete with henna painting, a presentation of turban scarves, and a mesmerizing Kathak Classical dance performance.

DAY 15 – Tuesday, November 18
Agra
Begin your day with a breathtaking sunrise visit to the Taj Mahal. Marvel at the grand marble mausoleum, the gardens, the spectacular exterior and the delicately tiled, domed interior. Later, you can explore the Taj Mahal further, appreciating its beauty and rich history before shopping for inlay marble and textiles at Kohinoor Jewelers and Kalakriti or returning to the hotel for some relaxation. For a more immersive experience, venture to Fatehpur Sikri, the magnificent "City of Victory," before returning for lunch. In the afternoon, explore the peaceful Tomb of Akbar at Sikandra, or visit Kachhpura and the exquisite Tomb of Itmad-Ud-Daulah, often called the “Baby Taj.” End the day with an elegant dinner at Bellevue, Esphahan, or enjoy in-room dining.
DAY 16 – Wednesday, November 19
Arrive in Tanzania

This morning, we depart India and arrive in Tanzania. Guests who have chosen to explore the Serengeti will take a one-hour charter flight to the Serengeti National Park, then board safari Jeeps to enjoy your first game drive en route to your lodge. T hose who have opted for the alternate destination, Ngorongoro Crater, will board a 30-minute charter flight to the Lake Manyara Airstrip, then enjoy a scenic drive in a safari Jeep to your lodge for check-in. Both Serengeti and Ngorongoro Crater guests will enjoy dinner at their respective hotels.

DAY 17 – Thursday, November 20
Serengeti Plain
Experience the majesty of the Serengeti National Park, a UNESCO World Heritage site and acacia woodland with a year-round water supply that creates an ideal environment for a wide variety of wildlife including countless zebra, buffalo, lions, cheetah, gazelle and wildebeest. Begin your time in the park with an early morning hot air balloon ride soaring over the vast Serengeti Plain. Marvel at spectacular views of the wildlife and scenery from above. After about an hour in the sky, touch down and indulge in an outdoor champagne breakfast in the plain. Enjoy a half-day game drive in search of the most scintillating game-viewing in Africa: great herds of buffalo, smaller groups of elephant and giraffe, and thousands upon thousands of elands, topi, kongoni, impala and Grant’s gazelle.

On your first full day in Tanzania, venture out on a morning game drive in the Ngorongoro Crater. This UNESCO World Heritage site is the world’s largest intact volcanic caldera. It is approximately 10 miles wide and creates a natural amphitheater for one of the densest populations of large animals anywhere. It hosts a spectacular array of wildlife, including rhinos, lions, water buffalo, zebra, elephants, Thompson’s gazelles and warthogs.

Serengeti Plain
See more of the Serengeti plain on either a full-day or half-day game drive. Set out in search of the most scintillating game-viewing in Africa: great herds of buffalo, smaller groups of elephant and giraffe, and thousands upon thousands of elands, topi, kongoni, impala and Grant’s gazelle. Tonight, gather for sundowners and a Majuto dance performance, followed by dinner in the bush.

Choose to spend a full day on a game drive, stopping at a Masai village, or opt for a half-day game drive in the morning or afternoon with lunch at the lodge. Arrive in Morocco, Marrakech
Both Serengeti and Ngorongoro guests will take charter flights from their respective locations and reunite in Kilimanjaro, Tanzania. Here, the group will continue on to Accra, Ghana, en route to culture-rich Marrakech, located in the fertile Haouz plain at the foot of the Atlas Mountains. Upon arrival in Marrakech this evening, transfer to the hotel for check-in and dinner, and look forward to tomorrow when you will spend the day either exploring the captivating Atlas Mountains or delving into Marrakech’s ancient walled quarter.

Atlas Mountains or Marrakech

Those looking to spend the day in the spectacular scenery of the Atlas Mountains, North Africa’s highest mountain range, will take a moderate hike to one of the Berber tribes that lives in this rugged land, where farming is central to day-to-day life. Sip tea with the village chief and enjoy a delicious traditional lunch before returning to Marrakech later this afternoon. Alternatively, those wanting to explore Marrakech will experience this bustling trading center’s medina, a UNESCO World Heritage site with winding alleys and shops. Stop at a local bakery, explore the artisan’s section of the city’s souk, meet the person in charge of heating the furnace of the public bath, browse an impressive photography gallery, and admire the Islamic and Moroccan style of the 16th-century El Badi Palace. In the afternoon, back in Marrakech, all guests will have the option to wander some of the city’s vibrant highlights with expert guides, including the Majorelle Garden, Jemaa el-Fna square, souks and culinary locations.

Itinerary Changes: The itinerary and staff are subject to modification and change by TCS. Health Requirements: Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. A form will be sent to you for your physician to sign. We are prepared to arrange for an alternative destination or activity if your physician recommends it. Any physical condition requiring special attention, diet, or treatment should be reported in writing when the reservation is made. We will make reasonable efforts to accommodate Participants with special needs; however, we cannot accommodate wheelchairs. If you require a slower pace, extra assistance, or the use of a cane or walking stick, arrangements will be made for private touring at each destination, if necessary, at the discretion of our Tour staff. Any extra cost for such arrangements will be the responsibility of the Participant. If you would like to forego some of the scheduled sightseeing to rejuvenate and relax, please feel free to do so at any time.
Medical forms will be made available and/or emailed to you approximately 7 days after your deposit has been received. You must review, complete and submit the forms at least 210 days prior to departure or within 30 days of booking if traveling within 210 days. Questions that relate to your physical or mental suitability must be completed by a medical practitioner. TCS CANNOT OFFER MEDICAL ADVICE. Should you fail to return the medical forms by the deadline stated herein, then such failure shall be deemed to be a material breach of this Agreement and will be treated as a cancellation by the traveler, subject to the cancellation fee schedule stated herein.
Provided a passenger returns their medical forms in time, if TCS denies a passenger from participating in a trip as a result of the disclosures on their medical forms then TCS shall inform the passenger, cancel their booking and issue a full refund to the passenger of all sums paid as of that date. TCS shall have no further liability in this scenario.
Medical forms must be filled out in full, honestly and accurately, and disclose all medical history and information. Should your medical situation change after submitting the medical forms, it is your responsibility to advise TCS immediately. TCS will review the information submitted and reserves the right to ask for further information, clarity on information, or for documentation from your medical practitioner. decision is made as a result of inaccuracies in the passengers medical forms then such will be treated as a cancellation by the traveler and shall be subject to the cancellation fee schedule stated herein.
Notwithstanding the foregoing, TCS reserves the right to: deny passage to any passenger on reasonable medical grounds, including, in the event that any medical officer determines that the traveler has not disclosed accurate medical information; or disembark any passenger at any port or place at any time whose presence, in the opinion of TCS or its medical advisers, may be detrimental to the comfort or safety of himself, other travelers, or who, in the opinion of TCS, might be excluded from landing at any port or place by immigration or other governmental authorities. In addition, TCS may remove or transfer the accommodations of or confine to a cabin/room, any passenger who may be suffering from contagious or infectious disease.
Use of Likeness and Images: You hereby grant to TCS the irrevocable right and permission to capture and use your name/photo- graph/image/voice/audio recording/video recording and likeness (collectively, “Your Images”) while on your tour for future pub- licity and promotional material in all forms or manner, without payment or other consideration. Participants who do not wish to be photographed during the Tour must inform TCS in writing prior to the Tour. In addition, you hereby grant TCS the irrevocable right and permission to reproduce or use any portion or all of any photograph/image/voice/audio recording/video recording that have been taken by you and submitted to TCS (collectively with Your Images, the “Images”) in any and all of its media, brochures, publi- cations, including web-based publications, without payment or other consideration. You understand and agree that all Images will become the property of TCS and will not be returned. You hereby irrevocably authorize TCS to edit, alter, copy, exhibit, publish, or distribute these Images for any lawful purpose. In addition, you waive any right to inspect or approve the finished product any right to royalties or other compensation arising or related to the use of the Images.
Basis of Rates: All prices are based on two persons sharing a room. All prices and fares are quoted in U.S. dollars. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While TCS will make reasonable efforts to maintain the listed prices, if it is necessary to levy a surcharge, TCS reserves the right to do so and will notify you at the time of final invoicing. TCS reserves the right to cancel the Tour because of inadequate enrollment that makes the Tour economically infeasible to operate. In such a case, a full refund of the Tour cost will be made.
Limitation of Liability: IN NO EVENT SHALL TCS BE LIABLE TO PARTICIPANT FOR ANY SPECIAL, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, OR INDIRECT DAMAGES, HOWEVER CAUSED, ON ANY THEORY OF LIABILITY, AND WHETHER OR NOT TCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TCS is not liable for injury, illness or death of any passenger unless directly caused by the negligence or willful misconduct of TCS. TCS hereby disclaims all liability for emotional distress, mental suffering/anguish, and psychological injury of any kind under any circumstances. Without limiting the preceding sentence, in no event will TCS be liable to a Participant for any consequential, incidental, exemplary or punitive damages.
Third Party Suppliers: TCS purchases air and ground transportation, hotel accommodations, and other services from various independent suppliers that are not subject to its control. These suppliers are independent contractors and acts of independent contractors are not acts of TCS. Neither TCS, its affiliates, owners, officers, agents, employees, contractors, nor any associated organization shall be held liable for any act, default, injury (including emotional injury, injury to person or property, or death), loss, expense, damage, deviation, delay, curtailment or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, even though such act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience may have been caused by or contributed to by defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. In issuing tickets for transportation of the travel by any means and making arrangements for travel, hotel or other accommodation, TCS is not acting as principal but only as agent for the companies, corporations, owner, public carriers or persons providing or offering the means of transportation and accommodation. You further understand that TCS neither owns nor operates such third party suppliers and accordingly, agree to seek remedies directly and only against those suppliers and not hold TCS responsible for their acts or omissions.
Force Majeure: Without limitation, TCS is not responsible for, and no refunds will be given for, delays or cancellation of all or part of your trip due to causes or circumstances beyond TCS’s responsibility or control, the, including but not limited to acts of God, perils of the sea, harbors, rivers, or other navigable waters, weather emergencies, breakdown, or failure of diving or mechanical equipment, government actions, inclement weather, sickness, attacks by animals, availability of emergency evacuation or medical care or the adequacy of the same, criminal activity of any kind, terrorism, war, civil disturbance, sanitary conditions, quality or sanitation of food, quarantine, customs, regulations, epidemics, strikes, hotel overbooking, safety and/or security standards at hotels, accommodations or otherwise, or for any other reason beyond the control of TCS, including, but not limited to, the failure by the Carrier to deliver the vessel to TCS for any reason whatsoever (each, herein referred to as a “Force Majeure Event”). For the avoidance of doubt, a Force Majeure Event also includes (a) the occurrence of any pandemic, epidemic or prevalent disease or illness with an actual or probable threat to human life as may be designated or determined by any local, city, county or state governmental entities, as applicable, or the federal government of the United States, the World Health Organization (WHO) or the U.S. Centers for Disease Control (CDC); including, without limitation, coronavirus, atypical pneumonia, Severe Acute Respiratory Syndrome (SARS), or avian influenza, or (b) adherence to any travel restriction, warning or advisory issued in relation thereto by any local, city, county or state governmental entities, as applicable, or the federal government of the United States, the World Health Organization (WHO) or the U.S. Centers for Disease Control (CDC), or (c) any quarantine or similar measure taken in relation thereto by any governmental agency or authority to prevent the spread of any communicable disease, or (d) any unavailability of any resources, information or services resulting from any of the foregoing including, without limitation, the unavailability of resources, information or services due to any governmental shut-downs or the unavailability or resources, information or services due to a shut-down, quarantine or similar measure of any third-party service provider whose service or information is relied upon TCS to operate the trip or otherwise fulfill its obligations under this Agreement.
Acknowledgment and Assumption of Risk: You understand and acknowledge that your travel in connection with and participation in the Tour may involve risk and potential exposure to illness (including, but not limited to infectious diseases such as, for example, (1) the risk of coming into close contact with individuals or objects that may be carrying an infectious disease; (2) the risk of transmitting or contracting an infectious disease, directly or indirectly, to or from other individuals), injury (including, but not limited to emotional injury or injury to person or property) and death. You also realize and acknowledge that risk,dangers and hazards may be caused by the negligence, fault or wrongdoing of other participants, contractors and/or subcontractors to TCS. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes. You fully understand and acknowledge that the aforementioned risks, dangers and hazards (collectively with any other risk of travel, the “Inherent Risks”) are a potential in connection with your travel and recreational activities which may take place during your Tour and hereby agree to assume such Inherent Risks.
Express Assumption of Risk and Responsibility/Participation: In recognition of the Inherent Risks of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in the Tour, that you are willingly and knowingly electing to participate in this Tour in spite of the potential risks, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, including emotional injury or injury to person or property. You understand and acknowledge that TCS reserves the right to accept or reject any participant for any reason, and TCS has the right to disqualify you from any Tour activity, if in TCS’s judgment, you are incapable of that activity and/or your continued participation in the Tour will endanger yourself or the safety of the group. It is your responsibility and obligation to inform TCS, at the time your reservation is made, of any medical or physical disability or limitation that might disable you or render you unable to perform or safely complete the Tour or any activity on the Tour, or subsequent to the time of reservation if such disability or limitation should arise. You further acknowledge that you are the best judge of your own conditions and limitations and that it is incumbent upon you to fully disclose the full extent of any such conditions or limitations to TCS.
Release: In consideration of the services and arrangements provided by TCS, you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify TCS, and its owners, officers, di-rectors, employees, contractors, subcontractors and affiliates from any and all claims, actions, or losses for damage, injury or death, including but not limited to any such claims, actions or losses for emotional injury, emotional distress, mental suffering/anguish, and psychological injury, bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the Tour and any activities conducted in conjunction therewith and shall include, without limitation, any loss caused by any act, omission, fault or negligence of the Participant or fellow travelers.
Express Waiver of Consequential, Punitive or Exemplary Damages: Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek consequential, punitive or exemplary damages against TCS its owners, officers, directors, agents, contractors and employees, for any reason whatsoever.
Medical Care: In the event medical care becomes necessary on your Tour, you may be hours or days travel by water, porter, animal, or other non-vehicular transportation from any medical facility. The medical facility you may be treated in may not have the same standards as hospitals or doctor’s offices in your home country. The medical personnel you will be treated by may not speak fluent English and have the same training as medical personnel in your home country. You further acknowledge that an emergency evacuation may be unavailable, expensive and delayed at your location, and that the medical facilities and attention available abroad may be limited. Decisions are made by TCS staff based on a variety of perceptions and evaluations of the situation at hand. Participant understands and agrees to abide by these decisions.
Safety Conditions: Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations such as to the countries to which Participant will be traveling on the Tour may involve greater risk than others. TCS urges each Participant review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to participating in the Tour. Information on conditions in the countries to which Participant will be traveling on the Tour and the level of risk associated with travel to those countries can be found at the “Country Specific Information,” “Travel Warnings,” “Travel Alerts,” and “Background Note” pages on the United States Department of State’s website. TCS DOES NOT REPRESENT OR WAR- RANT THAT TRAVEL TO ANY COUNTRY IS ADVISABLE OR WITHOUT RISK AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO THE COUNTRIES WHICH ARE PART OF THE TOUR.
Mediation/Arbitration: (A) The parties hereto agree that any and all disputes and claims that the each may have against the other that arise out of or relate to the Tour including the breach, termination, enforcement, interpretation or validity of these Terms and Conditions, including the agreement to arbitrate (the “Arbitration Agreement”) and the scope or applicability of this Arbitration Agreement (collectively, “Disputes”), including but not limited to the arbitrability of any and all Disputes, which are over US$15,000, will be resolved in a binding, confidential, individual and fair arbitration process as set forth herein, and not in court. The only exceptions to this Arbitration Agreement are that (i) Disputes of up to and including US$15,000 shall be pursued in Washington small claims court, and (ii) each party may bring suit in court against the other to enjoin infringement or other misuse of intellectual property rights. (B) This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act, 9 U.S.C. §§ 1-16, governs the interpretation and enforcement of this Arbitration Agreement. This Arbitration Agreement will survive termination of this Agreement. (C) If either the Participant or TCS wants to arbitrate a Dispute, the Participant or TCS must first send by mail to the other a written No- tice of Dispute (“Notice”) that sets forth the name, address, and contact information of the party giving notice, the specific facts giving rise to the Dispute, the Tour to which the Notice relates, and the relief requested. The Participant’s Notice to TCS must be sent by mail to TCS World Travel, 3131 Elliott Avenue, Seattle, WA 98121; Attn: Legal Department. TCS will send any Notice to the Participant at the contact information TCS has for the Participant or that the Participant provides. It is the sender’s responsibility to ensure that the recipient receives the Notice. During the first 45 days after the Participant or TCS sends a Notice to the other, the Participant and TCS may try to reach a settlement of the Dispute. If the Participant and TCS do not resolve the Dispute within those first 45 days, either the Participant or TCS may initiate arbitration as set forth herein. (D) Any arbitration between the Participant and TCS will be conducted by the American Arbitration Association (the “AAA”) and will be governed by the AAA’s Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, the “AAA Rules”), as modified by this Arbitration Agreement. The AAA Rules are available online at www.adr.org, or by calling the AAA at 1-800-778-7879. The arbitration will be conducted by a single arbitrator. If the Participant and TCS cannot agree on who that single arbitrator should be, then the AAA shall appoint an arbitrator with significant experience resolving the type of Dispute at issue. The arbitrator is bound by the terms of this Agreement. A form for initiating formal arbitration may be found on the AAA’s website at www.adr.org (“Arbitration Form”). In addition to filing this Arbitration Form with AAA in accordance with its rules and procedures, the Participant must send a copy of this completed Arbitration Form to TCS. (E) If the Participant is seeking to recover $100,000 or less (exclusive of interest on the sum claimed, cost of arbitration and legal expenses), AAA rules provide that the Dispute should be resolved without a hearing, by submission of documents only. Either the Participant or TCS may request a hearing, however, and be responsible for the fees associated with it. If the arbitrator recommends a hearing even if neither the Participant nor TCS request one, TCS will pay the arbitrator’s fees associated with the hearing. If the claim is for more than $100,000 (exclusive of interest on the sum claimed, cost of arbitration and legal expenses), the manner and place of the hearing will be in Seattle, Washington, USA or as otherwise agreed by the parties or determined in accordance with the AAA Rules, Principles, and Guidelines. (F) The Participant and TCS agree to maintain the confidential nature of any mediation and arbitration proceeding and shall not disclose the fact of the proceeding, any documents exchanged as part of the proceeding, the agreement, the arbitrator’s decision and the existence or amount of any agreement or award, except as may be necessary to prepare for or conduct the arbitration (in which case anyone becoming privy to confidential information must undertake to preserve its confidentiality), or except as may be necessary in connection with a court application for a provisional remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or court order.
Exclusive Governing Law and Jurisdiction: These Terms and Conditions and any Disputes, actions and legal proceedings whatso- ever by the Participant shall be governed exclusively, in all respects, and without regard to conflict of law principles, by the laws of the State of Washington, USA. Except as otherwise expressly specified in these Terms and Conditions, passenger agrees this choice of law supersedes and pre-empts any provision of law of any other state or nation.
Waiver of Jury Trial: In connection with any action or legal proceeding arising out of these Terms and Conditions, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.
Class Action Waiver: These Terms and Conditions provide for the exclusive resolution of disputes through individual legal action on the Participant’s own behalf instead of through any class action. Even if the applicable law provides otherwise, the Participant agrees that any legal action against TCS whatsoever shall be litigated by the Participant individually and not as a member of any class or as part of a class action, and the Participant expressly agrees to waive any law entitling the Participant to participate in a class action.
Time Limit for Claims: TCS shall not be liable for claims, actions, or losses for bodily injury, emotional injury or distress, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during the Tour and any activities conducted in conjunction therewith, unless full details in writing are given to TCS, within 185 days after the date of the event giving rise to such claim. Suit to recover on any such claim shall not be maintainable unless filed within one (1) year after the date of the event giving rise to such claim and unless served on TCS within 120 days after filing. You expressly waive all other potentially applicable state or federal limitation periods. If a written claim is not made and suit is not filed within the time frame set forth above, then the Participant waives and releases any right he or she may have to make any claim against TCS arising under, in connection with, or incident to the Tour.
Severability: If any provision of this Agreement shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
By registering for the Tour, the Participant agrees to the Operator-Participant Contract and Terms and Conditions set forth in this Agreement.

TCS World Travel shares the coverage available under the USTOA $1 Million Travelers Assistance Program with affiliates of Travelopia who, as an Active Member of the USTOA, is required to post $1 Million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA $1 Million Travelers Assistance Program, the advance payments of TCS customers in the unlikely event of TCS bankruptcy, insolvency or cessation of business. Further, you should understand that the $1 Million posted by Travelopia and shared among its affiliates may be sufficient to provide only a partial recovery of the advance payments received by TCS.
